1. Agreement to these terms

By accessing or using kiwi-orbit.com (the “Site”), you agree to these Terms & Conditions and our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Site.

You must be legally capable of accepting these terms. If you use the Site for an organisation, you confirm that you have authority to bind that organisation. A parent or guardian should supervise a young person's use and review the official age rating of any game.

2. What Kiwi Orbit provides

Kiwi Orbit is an independent editorial and discovery website about free-to-play online games. We publish reviews, ratings, comparisons and links intended to help readers decide what to try. The Site itself does not provide or operate the games.

No account is required to browse the Site. The “save” feature stores game names locally in your browser and does not create a Kiwi Orbit profile.

3. What “free-to-play” means here

When we describe a title as free-to-play, we mean that the publisher offers a playable base game or clearly identified starter experience without requiring purchase of that base product at the time of our review. It does not mean that every item, mode, expansion, character, convenience feature or service is free.

Publishers may sell optional cosmetics, virtual currency, subscriptions, passes, expansions, storage, account upgrades or accelerated progression. Prices, inclusions, regional access and platform requirements can change without notice. Some console features may require a platform account or subscription. Always verify current details on the official store before downloading or spending.

Virtual items and currencies belong to their respective game ecosystems. Kiwi Orbit does not sell, exchange, redeem or value them, and they cannot be withdrawn through this Site.

4. Third-party games and links

The Site links to publisher websites and digital stores for convenience. Those services are independent and governed by their own terms, privacy policies, age limits, community rules, purchase systems and refund policies. A link is not a guarantee, endorsement of every feature, or representation that a title will remain available in your location.

Kiwi Orbit is not responsible for:

• game downloads, installation, accounts, matchmaking, server performance or technical support;
• purchases, subscriptions, billing, refunds, virtual items or parental controls;
• player conduct, chat, user-generated content or online interactions;
• regional availability, latency, platform compatibility or data usage; or
• losses arising from a third-party service, subject to rights that cannot lawfully be excluded.

Take normal online-safety precautions. Download games only from official or trusted stores, use unique passwords and multi-factor authentication where available, and never share account credentials.

5. Ratings, accuracy and editorial independence

Kiwi Orbit ratings express our editorial opinion at the date shown. They are not public-vote averages, technical certifications or promises that you will enjoy a game. We consider free-path value, play quality, New Zealand relevance and player respect, but reasonable reviewers may disagree.

We aim for accurate, useful information. Live-service games change frequently, so modes, platforms, monetisation, system requirements and links may become outdated. You should confirm material details with the publisher. If you spot an error, email hello@kiwi-orbit.com.

Commercial relationships

Any paid placement, affiliate link, review copy or other material commercial relationship will be clearly disclosed near the relevant content. A high rating cannot be purchased. At the effective date, the catalogue's outbound links are ordinary editorial links.

6. Intellectual property

The Kiwi Orbit name, original logo, site design, original hero artwork, text, scoring framework and other original Site material are owned by or licensed to Kiwi Orbit and protected by applicable intellectual-property laws. You may view and make a reasonable personal copy for non-commercial use. You may not reproduce, scrape at scale, republish, sell, frame or create a competing dataset from our content without written permission, except where law permits.

Game titles, logos, screenshots, key art and related marks belong to their respective publishers and owners. They are displayed for identification, commentary and review. Kiwi Orbit is not sponsored, approved or endorsed by those owners unless explicitly stated.

7. Acceptable use

You must not use the Site to:

• break any law or infringe another person's rights;
• introduce malware, probe security, overload infrastructure or interfere with operation;
• circumvent access controls or attempt unauthorised access;
• use automated tools in a way that imposes an unreasonable load or ignores applicable directives;
• misrepresent an affiliation with Kiwi Orbit or a game publisher; or
• collect personal information from other users through the Site.

We may restrict access to protect the Site, users or our legal rights.

8. Availability, warranties and liability

The Site is provided on an “as available” basis. We may change, suspend or discontinue content or features. To the extent permitted by law, we do not promise uninterrupted access, error-free information, fitness for a particular purpose or compatibility with every device.

Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, including applicable rights under the Consumer Guarantees Act 1993 where it applies. To the extent permitted by law, Kiwi Orbit is not liable for indirect or consequential loss, loss of data, lost opportunity, or loss arising from a third-party game or service.

If you use the Site in trade, you agree that the Consumer Guarantees Act 1993 does not apply where contracting out is fair and reasonable and legally permitted. Our total liability for claims connected with this free editorial Site is limited to NZD 100, except where a different limit or remedy is required by law.

9. Changes and severability

We may update these terms to reflect changes to the Site, law or business practices. Revised terms take effect when posted with a new effective date. If a provision is invalid or unenforceable, it will be adjusted or severed to the minimum extent necessary and the remaining provisions will continue.

Our failure to enforce a provision is not a waiver. You may not transfer your rights under these terms without our consent. These terms, together with the policies referenced above, form the entire agreement about use of the Site.

10. Governing law and contact

These terms are governed by the laws of New Zealand. Subject to any mandatory consumer forum rights, the courts of New Zealand have non-exclusive jurisdiction over disputes connected with the Site.
